The only difference between this and a real D Latch is that this latch doesn't latch on the rising edge but on the clock, if the data input changes while the clock is still high then it overwrites the data.

If you add a capacitor in series with the clock and then a pull down resistor for the FET gates then you could generate a pulse on the rising edge, like a rising edge detector.

that's why it's called a D latch. flip-flops are the one triggered by an edge.

No, read the specification your latch or flip flop, if its taken over the data on edge or static is written in specification. There are all variants available even for rising or falling edge.
